These Terms of Service ("Terms") govern your use of MarketMyAI.com ("we", "us", "our") and the AI tool distribution services we provide. By using our website or purchasing a service, you agree to these Terms.
1. Service Description
MarketMyAI is an AI tool distribution service. We manually submit your AI tool to curated directories, newsletters, and influencer channels to increase your tool's visibility and reach. Our packages include submissions to varying numbers of directories, newsletter features, and influencer outreach depending on the tier you select.
2. Pricing and Payment
- All services are one-time payments - there are no recurring subscriptions unless explicitly stated.
- Payments are processed securely through Stripe. We do not store your payment details.
- Prices are listed in USD and are subject to change. The price at the time of purchase applies to your order.
- Orders are non-refundable once work has begun (i.e., once we start submitting your tool to directories). If we have not yet started, you may request a full refund within 48 hours of purchase.
3. Delivery Timelines
We aim to complete all submissions within the timeframe specified in your package (typically 7-14 business days). However, delivery timelines are best-effort estimates, not guarantees. Directory review times, newsletter publishing schedules, and influencer availability are outside our control and may cause delays.
4. No Guarantee of Results
We submit your tool - we do not control outcomes. Specifically:
- We do not guarantee that any specific directory will accept or feature your tool.
- We do not guarantee any amount of traffic, signups, downloads, or revenue.
- We do not guarantee any specific ranking or placement within a directory.
- Directory acceptance criteria are set by each directory independently and may change without notice.
What we do guarantee: we will submit your tool to every channel included in your package and provide you with a delivery report showing each submission and its status.
5. Acceptable Use
You agree that the AI tool you submit for distribution:
- Is a legitimate product or service that you own or have authorization to promote.
- Does not contain malware, spyware, or any malicious code.
- Does not promote illegal activities, hate speech, or violence.
- Does not contain adult or sexually explicit content.
- Does not infringe on any third party's intellectual property rights.
- Has a functioning URL and is accessible at the time of submission.
We reserve the right to refuse service to any tool that violates these conditions, without refund.
6. Your Responsibilities
You are responsible for:
- Providing accurate information about your AI tool (name, URL, description, category).
- Ensuring your tool's URL is live and functional throughout the distribution period.
- Responding to any follow-up requests we may need to complete submissions (e.g., logo files, screenshots).
7. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claim arising from the service shall not exceed the amount you paid for that service.
- We are not liable for indirect, incidental, consequential, or punitive damages.
- We are not liable for any loss of revenue, traffic, or business opportunities resulting from directory rejections, listing removals, or algorithm changes by third-party platforms.
8. Intellectual Property
You retain full ownership of your AI tool and all associated intellectual property. By using our service, you grant us a limited license to use your tool's name, logo, description, and screenshots solely for the purpose of submitting it to directories and promotional channels on your behalf.
9. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the service after changes constitutes acceptance of the revised Terms. For material changes, we will notify active customers via email.
10. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be settled through binding arbitration.
